1. Acceptance of Terms

By downloading, installing, or using the Watcho mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Taque Studios ("we," "us," or "our"). We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.

2. Description of the App

Watcho is a public safety awareness application that displays reported incidents on a map of Southern California, with coverage expanding to other parts of California. The App is provided for informational and reference purposes only. All content is curated and posted exclusively by Taque Studios.

Incidents are categorized into three types: Reported Kidnapping (confirmed enforcement or detention activity), Suspicious Sighting (unconfirmed vehicles or activity), and Happening Now (active real-time incidents). The App also provides address and neighborhood search, incident type filtering, and a bilingual interface in English and Spanish.

3. Content Ownership and Curation

All incident pins, descriptions, and related content displayed in the App are created, reviewed, and published solely by Taque Studios. There is no user-generated content of any kind.

Taque Studios retains all rights to the content published through the App. Content may be updated, removed, or corrected at any time at our sole discretion.

4. Accuracy Disclaimer

Watcho makes a good-faith effort to post accurate, timely information about public safety incidents. However, Taque Studios makes no warranty or guarantee regarding the accuracy, completeness, timeliness, or reliability of any content displayed in the App.

Incidents are reported based on available information at the time of posting. Details may be incomplete, change over time, or be corrected after initial publication. You should verify information through official sources before acting on it.

5. Not an Emergency Service

Watcho is not an emergency service.

The App is an informational reference tool only. It is not a substitute for official law enforcement communications, emergency alerts, or government public safety systems.

If you are in danger, witness a crime, or have an emergency, call 911 immediately.

Do not rely on Watcho for real-time safety decisions, evacuation guidance, or emergency response. Taque Studios is not responsible for any harm arising from reliance on the App in an emergency situation.

6. Permitted Use

You may use the App for personal, non-commercial informational purposes. You agree not to:

• Reproduce, distribute, or commercially exploit any content from the App without written permission from Taque Studios
• Attempt to reverse engineer, decompile, or extract source code from the App
• Use the App to harass, threaten, or harm any individual or group
• Use automated tools to scrape or extract data from the App
• Attempt to gain unauthorized access to any portion of the App or its backend systems
• Use the App in any way that violates applicable local, state, or federal law

7. Intellectual Property

The Watcho name, logo, app design, and all original content are the intellectual property of Taque Studios and are protected by applicable copyright and trademark law. All rights reserved.

Nothing in these Terms grants you any ownership interest in the App or its content.

8. Third-Party Services and Links

The App may display links to external sources such as news articles. These links are provided for reference only. Taque Studios does not endorse, control, or take responsibility for the content of any external website. Accessing external links is at your own risk.

8.1 Family Donation Links (GoFundMe)

Certain incident entries display a "Support this family" or "Donate" button that links to a GoFundMe crowdfunding campaign organized by the affected family or their representatives. By using this feature, you acknowledge and agree that:

• Taque Studios is not a recipient, processor, intermediary, or fiduciary for any donation. All transactions are conducted directly between you and GoFundMe (a third-party platform operated by GoFundMe.com) once you leave the App via the link.
• No payment, donation, or financial transaction ever occurs within the App. The Watcho app does not collect or transmit any payment information.
• Taque Studios receives no portion of any donation. We do not take a percentage, fee, or kickback of any kind. We do not solicit donations on our own behalf.
• Taque Studios does not verify, endorse, or guarantee the legitimacy of any third-party fundraising campaign, the identity of the campaign organizer, or how donated funds will be used. Campaign listings are included based on publicly available information at the time of posting and may be updated, corrected, or removed at our sole discretion.
• You are solely responsible for evaluating any fundraising campaign before donating. We strongly recommend reading the GoFundMe campaign description in full and reviewing GoFundMe's own terms (https://www.gofundme.com/c/terms) before contributing.
• Donations are governed by GoFundMe's terms, not these Terms. GoFundMe is responsible for payment processing, refund policies, donor receipts, tax treatment, and dispute resolution related to any donation.

Taque Studios disclaims any and all liability for losses, disputes, or grievances arising from third-party fundraising campaigns linked from the App.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TAQUE STUDIOS DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TAQUE STUDIOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF LIFE, PERSONAL INJURY, PROPERTY DAMAGE, OR FINANCIAL LOSS.

IN NO EVENT SHALL TAQUE STUDIOS'S TOTAL LIABILITY TO YOU EXCEED ONE HUNDRED DOLLARS ($100.00).

11. Indemnification

You agree to indemnify, defend, and hold harmless Taque Studios and its owner, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorney's fees) arising from your use of the App or violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the App shall be resolved in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.

13. Changes to These Terms

We may update these Terms at any time by posting the revised version on this page with an updated effective date. It is your responsibility to review these Terms periodically. Continued use of the App after changes are posted constitutes your acceptance.
